Examination

The Independant Examiner, Mr Martin Lee, was appointed by Harborough District Council to undertake the Examination of the Arnesby Neighbourhood Plan.

The Examiners report was received on 30 November 2018 and recommended that with some minor modifications the Plan met the Basic Conditions and should proceed to Referendum.

Referendum

The Arnesby Neighbourhood Plan and Examiners report was presented to Executive Committee on 14 January 2019. The Executive approved  all of the Examiners suggested modifications and for the Plan to proceed to referendum on 28 February 2019.

The Arnesby Neighbourhood Plan Decision statement of the Local Planning Authority’s satisfaction that the referendum version Neighbourhood Plan meets the basic conditions specified by statute and complies with the provision made by or under Section 38A and 38B of the Planning and Compulsory Purchase Act 2004

The Referendum results for the Arnesby Neighbourhood Plan Referendum held on 28 February 2019 are as follows

Examination

Regulation 14

The community undertook their regulation 14 consultation between 29 Jan 2018 and 12 March 2018.

Submission to Harborough District Council

Arnesby Parish Council as the Qualifying Body submitted the Arnesby Neighbourhood Plan on 3 May 2018. The Council has undertaken a validation check and the Plan will now proceed to a 6 week regulation 16 consultation from Wednesday 20 June 2018 ending on 1 August 2018.

Examination

Independant Examiner, Mr Martin Lee, has been appointed by the LPA with agreement from the Qualifying Body.

Strategic Environmental Assessment Screening

The District Council has been asked by the Qualifying Body to undertake a screening report to assess the requirement for an SEA for the Plan. The Screengin report states that an full SEA is not required fo rthe Plan. The Statutory Consultees have been contacted and asked to comment. On receipt of the comments from the Natural England, Historic England and the Environment Agency the Local Planning Authority will issue its determination shortly.

The District Council has now completed its determination for the requirement for an SEA for the Arnesby Neighbourhood Plan. The Authority has determined that a full SEA is not required because, in the opinion of the Authority, there will not be significant detrimental effects to either the natural or historic environment

Approval of Neighbourhood Area

Arnesby Parish Council, as the relevant body, applied for the designation of the Arnesby Neighbourhood Area. The application was published for a six week period ending on  3 August 2016 and was approved by the Portfolio Holder for Planning Services on 4 August 2016.
