On 15th October 2018 the Executive Committee approved all the Examiners recommended modifications and for the Burton Overy Neighbourhood Plan to proceed to referendum on 10th January 2019.

Referendum Result

A referendum was held on 10th January 2019 and a ‘yes’ vote was returned with 73 out of 77 persons that voted, voting ‘to use the Neighbourhood Plan for Burton Overy to help it decide planning applications in the Neighbourhood area.’

Final Decision Statement

Harborough District Council has assessed that the Burton Overy Neighbourhood Plan, including its preparation, does not breach, and would not otherwise be incompatible with, any EU obligation or any Convention rights (within the meaning of the Human Rights Act 1998).

In accordance with the Regulations and the Council's scheme of delegation the Burton Overy Neighbourhood Development Plan is 'made' and planning applications in the Parish must be considered against the Burton Overy Neighbourhood Development Plan, as well as existing planning policy, such as the Harborough District Core Strategy and the National Planning Policy Framework and Guidance

Referendum Result

The referendum held on 10th January 2019 met the requirements of the Localism Act 2011; it was held in the Parish of Burton Overy and posed the question:

'Do you want Harborough District Council to use the Neighbourhood Plan for Burton Overy to help it decide planning applications in the Neighbourhood area?'

The count took place on 10th January 2019  and greater than 50% of those who voted were in favour of the Plan being used to help decide planning applications in the plan area. The results of the referendum were:

Examination

Submission of Burton Overy Neighbourhood Plan

Burton Overy Neighbourhood Plan was submitted by Burton Overy Parish Council, as the Qualifying Body, to Harborough District Council for examination on 21 March 2018. A validation check has been completed.

Regulation 16 Consultation

In accordance with the regulations the dates for the Regulation 16 consultation were between 18 April to 30 May 2018.

Examination

Strategic Environmental Assessment

Burton Overy Parish Neighbourhood Forum asked the LPA to screen the Burton Overy NDP for requirement for a Strategic Environmental Assessment (SEA). A screening report was provided in January 2018 for the pre submission version of the Plan. Statutory Consultees were asked for their comments . Natural England, Historic England and the Environment Agency confirmed that they did not consider a full SEA was required for the Plan.

The determination will shortly be issued by the LPA in May/June 2018 whether in the opinion of the LPA a full SEA is required for the Burton Overy Neighbourhood Plan. The documents can be found below

Approval of Neighbourhood Area

Burton Overy Parish Council, as the relevant body, applied for the designation of the Burton Overy Neighbourhood Area. The application was published for a six week period ending on  27 July 2015 and was approved by the Portfolio Holder for Planning Services on 31 July 2015. Regulation 14 Consultation

The pre submission version of the Burton Overy Neighbourhood Plan went out for consultation between 29 November 2017 and 14 January 2018.
