Examiners Report

The Examiners Report for the East Langton Neighbourhood Plan was received by Harborough District Council on 22 February 2018.

The Examiners Report recommended that, with modifications, the East Langton Neighbourhood Plan proceed to a referendum. The recommended referendum area is the Parish of East Langton to include those homes that are part of the village of Church Langton but inside West Langton Parish.

The Examiners report was  presented to the 9 April Executive Committee and was approved to proceed to referendum on 21 June 2018.

The East Langton Neighbourhood Plan Decision statement of the Local Planning Authority’s satisfaction that the referendum version Neighbourhood Plan meets the basic conditions specified by statute and complies with the provision made by or under Section 38A and 38B of the Planning and Compulsory Purchase Act 2004

Referendum Results

A referendum was held on 21st June 2018 and a ‘yes’ vote was returned with 132 out of 147 persons that voted, voting ‘to use the Neighbourhood Plan for East Langton to help it decide planning applications in the Neighbourhood area.’

Final Decision Statement

Harborough District Council has assessed that the East Langton Neighbourhood Plan, including its preparation, does not breach, and would not otherwise be incompatible with, any EU obligation or any Convention rights (within the meaning of the Human Rights Act 1998).

In accordance with the Regulations and the Council's scheme of delegation the East Langton Neighbourhood Development Plan is 'made' and planning applications in the Parish must be considered against the East Langton Neighbourhood Development Plan, as well as existing planning policy, such as the Harborough District Core Strategy and the National Planning Policy Framework and Guidance.

Referendum Result

The referendum held on 21st June 2018 met the requirements of the Localism Act 2011; it was held in the Parish of East Langton and posed the question:

'Do you want Harborough District Council to use the Neighbourhood Plan for East Langton to help it decide planning applications in the Neighbourhood area?'

The count took place on 21st June 2018  and greater than 50% of those who voted were in favour of the Plan being used to help decide planning applications in the plan area. The results of the referendum were:

Examination

The East Langton Neighbourhood Plan has been submitted by East Langton Parish Council and East Langton Neighbourhood Plan Steering Group to Harborough District Council for examination.

Examination

An Independent Examiner, Mr Timothy Jones, has been appointed by Harborough District Council with the agreement of the Qulaifying Body.

Land Owner Consultation 24 July to 4 Spetmber 2017

A further consultation was undertaken by Harborough District Council , with the agreement of the Independent Examiner and the Qualifying Body, to ensure that all landowners who had not been contacted as part of the Regulation 14 and Regulation 16 consultations had been given the opporunity to comment on the East Langton Neighbourhood Plan.

The representations received, and the Qualifying Body comments have been forwarded to the Independent Examiner to be considered as part of the Examination evidence.

Approval of Neighbourhood Area

East Langton Parish Council, as the relevant body, applied for the designation of the East Langton Neighbourhood Area. The application was publicised for a six week period ending on 4 October 2013 and was approved by the Portfolio Holder for Planning Services on 9 October 2013. Pre-submission Consultation

The pre-submission consultation for East Langton Neighbourhood Plan was completed by the community between 15th October 2015 and 27th November 2015.
