The Examiners Report for the Shearsby Neighbourhood Plan was received by Harborough District Council on 25 September 2018.

The Examiners Report recommended that, with modifications, the Shearsby Neighbourhood Plan proceed to a referendum. The recommended referendum area is the Parish of Shearsby.

The recommended modifications was presented to the Executive Committee for consideration on 13 November 2018. Executive Committee approved all of the Examiners recommendations.

The date for the Shearsby Neighbourhood Plan Referendum is 10 January 2019.

Referendum

At its meeting on 13 November 2018 Executive Committee approved the Shearsby Neighbourhood Plan to proceed to referendum on 10 January 2019, and accepted all of the Examiners recommendations.

The Shearsby Neighbourhood Plan Decision statement of the Local Planning Authority’s satisfaction that the referendum version Neighbourhood Plan meets the basic conditions specified by statute and complies with the provision made by or under Section 38A and 38B of the Planning and Compulsory Purchase Act 2004

The Neighbourhood Plan Referendum Information Statement sets out the arrangement for the Referendum including costs and voter numbers

Referendum Result

A referendum was held on 10 January 2019 and a ‘yes’ vote was returned with 105 out of 113 persons that voted, voting ‘to use the Neighbourhood Plan for Shearsby to help it decide planning applications in the Neighbourhood area.’

Final Decision Statement

Harborough District Council has assessed that the Shearsby Neighbourhood Plan, including its preparation, does not breach, and would not otherwise be incompatible with, any EU obligation or any Convention rights (within the meaning of the Human Rights Act 1998).

In accordance with the Regulations and the Council's scheme of delegation the Shearsby Neighbourhood Development Plan is 'made' and planning applications in the Parish must be considered against the Shearsby Neighbourhood Development Plan, as well as existing planning policy, such as the Harborough District Core Strategy and the National Planning Policy Framework and Guidance

Referendum Result

The referendum held on 10th January 2019 met the requirements of the Localism Act 2011; it was held in the Parish of Shearsby and posed the question:

'Do you want Harborough District Council to use the Neighbourhood Plan for Shearsby to help it decide planning applications in the Neighbourhood area?'

The count took place on 10th January 2019  and greater than 50% of those who voted were in favour of the Plan being used to help decide planning applications in the plan area. The results of the referendum were:

Examination

Submission of Shearsby Neighbourhood Plan

Shearsby Neighbourhood Plan was submitted by Shearsby Parish Council to Harborough District Council for examination on 1 February 2018. A validation check has been undertaken.

Examination

An Independant Examiner, Mr Martin S Lee, has been appointed by Harborough District Council to Examine the Shearsby Neighbourhood Plan.

The Examiners recommended modificaitons will be presented to Executive Committee on 13 November 2018 for decision to proceed to Referendum. The proposed date for the Referendum is 10 January 2019

Strategic Environmental Assessment

Shearsby Parish Council asked the LPA to screen the Shearsby NDP for requirement for a Strategic Environmental Assessment (SEA). Screening reports were provided in September 2017 and February 2018. Statutory Consultees were asked for their comments in February 2018. Natural England and Historic England confirmed that they did not consider a full SEA was required for the Plan.

The detemination was issued by the LPA in April 2018 that a full SEA was not required for the Shearsby Neighbourhood Plan. The documents can be found below

Approval of Neighbourhood Area

Shearsby Parish Council, as the relevant body, applied for designation of the Shearsby Neighbourhood Area on 12 November 2014. The application was advertised for a 6 week period ending on 5 January 2015 and was approved by the Portfolio Holder for Planning Services on 16 January 2015.
