The Chief Executive has agreed that all the Examiner’s recommended modifications should be accepted and that the amended Neighbourhood Plan should proceed to a referendum.

The modifications proposed by the examiner have been made to secure that the draft plan meets the basic conditions. Appendix  A of the Decision Statement sets out these modifications and the action to be taken in respect of each of them.

The District Council agrees with the Examiner’s recommendation that there is no reason to extend the Neighbourhood Plan area for the purpose of holding the referendum. 

The Examiner has concluded that with the specified modifications the Plan meets the basic conditions and other relevant legal requirements.  The District Council concurs with this view and that the Plan complies with the provision made by or under sections 38A and 38B of the 2004 Act. Therefore, to meet the requirements of the Localism Act 2011 a referendum which poses the question

Do you want Harborough District Council to use the Neighbourhood Plan for Tugby and Keythorpe to help it decide planning applications in the neighbourhood area?

will be held in the Parish of Tugby and Keythorpe.

The date on which the referendum will take place is agreed as 27 October 2022.

Examination

Strategic Environmental Assessment

The draft Tugby and Keythorpe Neighbourhood Plan as submitted in December 2020 has been screened fo rthe requirement of a Strategic Environmental Assessment. The screening finds that a full SEA is not required. The Qualifying Body have been informed and the Statutory Consultees have been consulted.

The SEA determination was issued by the Coucnil in Feb 2022 finding that a full SEA was not required

Submission of Plan

The Tugby and Keythorpe Neighbourhood Plan was submitted to the Council on 17 November 2021. After checks and validation of the submission documents the Plan was made available for Regulation 16 consultation between 19 January 2022 and 2 March 2022.

Examination

The examiner, Andrew Matheson, has forwarded a number of questions of clarification to the Qualifying Body concerning the Tugby and Keythorpe Neighbourhood Plan. In the interests of transparency these questions and the Qualifying Body repsonses can be found below.

The Examiner  will consider whether the Plan met the Basic Conditions which are that the Plan must:

  • have regard to national planning policy and advice contained in guidance issued by the Secretary of State (e.g. National Planning Policy Framework);
  • contribute to the achievement of sustainable development;
  • be in general conformity with strategic policies in the development plan for the local area (i.e. Local Plan); and
  • be compatible with EU obligations and human rights requirements.

Examiners Report

The Examiners final report was received on 29 June 2022. In his report the Examiner concludes that the Plan, subject to some specified modifications, should proceed to a Referendum based on the Tugby and Keythorpe Neighbourhood Area as approved 30 October 2017

Approval of Neighbourhood Area

Designation of Neighbourhood Area

Tugby and Keythorpe Parish Council, as the Qualifying Body, applied to designate the Tugby and Keythorpe Neighbourhood Area on 30 October 2017.

In accordance with Part 2 Regulation 5 of the Neighbourhood Planning (General) Regulations 2012 The Council is able to confirm that the organisation making the application is a Relevant Body for the purposes of section 61G of the 1990 Act and the application is in compliance with Part 2 Regulation 5 of the Neighbourhood Planning (General) Regulations 2012.
