At the Cabinet meeting on 7 March 2022 the Leire Neighbourhood Plan, as amended by the Examiners recommended modifications, was approved to proceed to referendum on 12 May 2022.

The referendum version plan and other specified documents will be publicised at the following locations

The Leire Neighbourhood Plan Decision is the statement of the Local Planning Authority’s satisfaction that the referendum version Neighbourhood Plan meets the basic conditions specified by statute and complies with the provision made by or under Section 38A and 38B of the Planning and Compulsory Purchase Act 2004

Referendum

After a successful referendum on 12 May 2022 the Council issued the Decision Notice to make the Leire Neighbourhood Plan on 16 May 2022

Referendum Results

The referendum held on 12 May 2022 met the requirements of the Localism Act 2011; it was held in the Parish of Leire and posed the question:

'Do you want Harborough District Council to use the Neighbourhood Plan for Leire to help it decide planning applications in the Neighbourhood area?'

The count took place on 12 May  2022 and greater than 50% of those who voted were in favour of the Plan being used to help decide planning applications in the plan area. The results of the referendum were:

Examination

Submission of Leire Neighbourhood Plan

Complaints regarding the Leire Neighbourhood Plan preparation

Harborough District Council has received a number of complaints concerning the preparation of the Leire Neighbourhood Plan. These include:

  • Transparency 
  • Consultation
  • Allocation of housing site

It is not for the District Coucnil to comment on the merit of particular policies or to preempt the Examiner opinion as to whether the Plan meets the Basic Conditions, but to be satisfied that the Plan has met the legal requirements for submission to the District Council. The Qualifying Body has clarified the points raised by complainants and provided further information to satisfy the District Council that the legal requirements have been met. All documents have been redacted.

Leire Neighbourhood Plan was submitted by Leire Parish Council, as the Qualifying Body, to Harborough District Council for examination on 6 January 2021. The validation that was completed has now been reopened by the Council.  The validation will be completed on the resubmission of the specified documents.

Update 3/3/21: The progress of the Leire Plan has been suspended until it is confirmed all the documents on the PC website are up to date and available to those wishing to view them.

Update 5/3/21: The Council has been informed by a resident that some of their representations made at Regulation 14 stage are still missing from the Consultation Statement. The Qualifying Body has been informed and asked to check and amend the documents and resubmit all the documentation for Examination. A further validation of the newly submitted documents will be undertaken. 

Update 17/3/21: After further clarificaiton from the Qualifying Body concerning the tiemline of consultation, updating the Parish Coucnil website, checking and resubmitting the statutory documents to Harborough District Council, the Council is satisfied that the submisison of the Leire Neighbourhood Plan meets the legal requirements and will proceed to Regulation 16 consultation between 7 April and 19 May 2021.

Regulation 16 Consultation

In accordance with the regulations the dates for the Regulation 16 consultation were between 7 April and 19 May 2021.

Representations were sought from stakeholders and other consultees and all representations will be forwarded to the Independant Examiner in due course.

Examination

Mr Tim Jones (Barrister, No 5 Chambers) has been appointed to the examination of the Leire Neighbourhood Plan. The Examination commenced on 27 July 2021.

Formal Compaint from resident

Strategic Environmental Assessment

Harborough District Council undertook a screening of the draft Leire Neighbourhood Plan in September 2020 for the purposes of Strategic Environmental Assessment (SEA). The statutory consultees were contacted for comment and the determination has been issued by the Council.

Receipt of Examiners Report

The Examiners report was received by the Council on 26 January 2022. 

The report was presented to Cabinet on 7 March 2022 where the Cabinet made  its decision about each of the recommended modifications. The Cabinet decision is to proceed to referendum the date of the referendum.

The date for the referendum is 12 May 2022.

Approval of Neighbourhood Area

Leire Parish Council, as the relevant body, applied for the designation of the Leire Neighbourhood Area on 23 November 2017. The application for the Neighbourhood Area is the entire Parish of Leire.

In accordance with Regulation 5A of the Neighbourhood Planning Regulations the Local Authority must exercise their powers under section 61G of the 1990 Act to designate the specified area as a neighbourhood area.

Harborough District Council confirmed the designation of Leire Neighbourhood Area on 4 December 2017.
