Neighbourhood Plan Review

The review of the Great Bowden Neighbourhood Plan commenced in 2019 and the Plan was submitted to the Council on 28 May 2020.

The changes made to the Great Bowden Neighbourhood Plan were only minor changes to update the Plan in accordance with the NPPF 2019 and the Local Plan 2011 to 2031.

The amendments to the Plan are non material changes  that do not materially affect the policies in the plan. In this case, a local planning authority (HDC) may make such updates but only with the consent of the qualifying body (GBPC). Consultation, examination and a referendum are not required in this situation.

The Great Bowden Review Plan was submitted to Cabinet for approval on 5th October 2020. Cabinet approved the Plan to be adopted.

The ‘made’ date for a Plan that has been subject to minor (non material) modifications will remain unchanged, although the review date is shown in the Councils documentation. A Plan reviewed with minor (non material ) modifications will not immediately benefit from the protection that paragraph 14 (a) of the NPPF provides to ‘made’ Plans unless the criteria are met.

Paragraph 14 and 14(a) sets out that the protection can apply where the presumption (at paragraph 11(d)) applies to applications involving the provision of housing, the adverse impact of allowing development that conflicts with the neighbourhood plan is likely to significantly and demonstrably outweigh the benefits, provided  the neighbourhood plan became part of the development plan 5 years or less before the date on which the decision is made. This includes circumstances in which the neighbourhood plan is updated by way of making a material modification to the plan, (provided the relevant criteria continue to be met including that the neighbourhood plan contains policies and allocations that meet the identified housing requirement for the neighbourhood area). In updating the neighbourhood plan, it will be important to ensure that sites identified for years 1-5 are deliverable in line with paragraph 67 and 68 of the National Planning Policy Framework.

Approval of Neighbourhood Area

Great Bowden Parish Council, as the relevant body, applied for the designation of the Great Bowden Neighbourhood Area. The application was published for a 6 week period ending on 27 November 2015 and was approved by the Portfolio Holder for Planning Services on 5 December 2015.
