Submission of Plan 

The following documents were submitted by the Qualifying Body for Regulation 16 consultation and examination on 5 June 2026.

The Qualifying Body has submitted their statement of modifications and consider that the review plan requires examination but not referendum as the modifications are material but do not change the nature of the plan.

The submission version plan has been validated by the District Council

The Council has considered the modifications to the Shearby Neighbourhood Plan and has provided the following statement of modifications. The Council agrees that the modifications are material but do not change the nature of the Plan and requires examination but not referendum.

Regulation 16 Consultation 

The Shearsby NDP Review plan is scheduled to commence regulation 16 on 22 July 2026.

Harborough District Council will appoint a suitably qualified Examiner to carry out an examination into the Shearsby Neighbourhood Plan Review. Please note that all representations received during the consultation period will be forwarded to the appointed Examiner and made publicly available.  

The Examiner is obliged to consider whether the amendments to Shearsby Plan Review are:

  • Minor (non-material) modifications to a neighbourhood plan or order are those which would not materially affect the policies in the plan or permission granted by the order. These may include correcting errors, such as a reference to a supporting document, and would not require examination or a referendum.
  • Material modifications which do not change the nature of the plan or order would require examination but not a referendum. This might, for example, entail the addition of a design code that builds on a pre-existing design policy, or the addition of a site or sites which, subject to the decision of the independent examiner, are not so significant or substantial as to change the nature of the plan.
  • Material modifications which do change the nature of the plan or order would require examination and a referendum. This might, for example, involve allocating significant new sites for development.

The Qualifying Body and the Local Planning Authority have both submitted statements of modification to the examiner and agree that the review plan requires examination but not refereendum. The examiner will make the decision whether the plan requires examination and referendum.

In completing the representation form, please be aware that the Examiner will only be testing whether the proposed Neighbourhood Plan meets the basic conditions and other relevant legal requirements. The Examiner will not be testing the soundness of the plan or looking at other material considerations but checking that the plan:  

  • Has regard to national policy and advice contained in guidance issued by the Secretary of State;
  • Contributes to the achievement of sustainable development;
  • Is in general conformity with the Local Plan;
  • Does not breach, and is otherwise compatible with, EU and human rights obligations;
  • Meets prescribed conditions and complies with prescribed matters;
  • Meets the legal requirements;

Strategic Environmental Assessment

The following documents were submitted in September 2024 to support the request for an SEA screening to be undertaken

Harborough District Council screened the Shearsby Plan as submitted in September 204 and asked the statutory consultees for comment on the screening outcomes.

The Determination issued in December 2024 forund that the Shearsby Review Neighbourhood Plan did not require a full SEA to be undertaken.

Approval of Neighbourhood Area

Shearsby Parish Council, as the relevant body, applied for designation of the Shearsby Neighbourhood Area on 12 November 2014. The application was advertised for a 6 week period ending on 5 January 2015 and was approved by the Portfolio Holder for Planning Services on 16 January 2015. View a map identifying the designated Shearsby Neighbourhood Area(PDF, 199KB).
