Submission of Plan 

The following documents were submitted by the Broughton Astley Parish Council (the Qualifying Body) for Regulation 16 consultaiotn and examination on 28 April 2026..

The Qualifying Body has submitted their statement fo modifications and consider that the review plan requires examination and referendum as the modifications are material and do change the nature of the plan.

The Council has considered the modifications to the Broughton Astley Neighbourhood Plan and has provided the following statement of modifications. The Council agrees that the modifications are material and do change the nature of the Plan and require examination and referendum.

Regulation 16 Consultation

The consultation runs from 27 May 2026 to 8 July 2026.

Examination

With agreement of the Qualifying Body, Harborough District Council Council appointed Louise Brooke- Smith for the independent examination of Broughton Astley Neighbourhood Plan.

All the representations received as part of the Regulation 16 consutlation will be forwarded to Dr Brooke- Smith for consideration.

The Examiner is obliged to consider whether the amendments to Brouthon Astley Plan are:

  • Minor (non-material) modifications to a neighbourhood plan or order are those which would not materially affect the policies in the plan or permission granted by the order. These may include correcting errors, such as a reference to a supporting document, and would not require examination or a referendum.
  • Material modifications which do not change the nature of the plan or order would require examination but not a referendum. This might, for example, entail the addition of a design code that builds on a pre-existing design policy, or the addition of a site or sites which, subject to the decision of the independent examiner, are not so significant or substantial as to change the nature of the plan.
  • Material modifications which do change the nature of the plan or order would require examination and a referendum. This might, for example, involve allocating significant new sites for development.

The Qualifying Body and the Local Planning Authority have both submitted statements of modification to the examiner and agree that the review plan requires examination and referendum. The examiner will make the decision whether the plan requires examination and referendum.

The Examiner will only be testing whether the proposed Neighbourhood Plan meets the basic conditions and other relevant legal requirements. The Examiner will not be testing the soundness of the plan or looking at other material considerations but checking that the plan:  

  • Has regard to national policy and advice contained in guidance issued by the Secretary of State;
  • Contributes to the achievement of sustainable development;
  • Is in general conformity with the Local Plan;
  • Does not breach, and is otherwise compatible with, EU and human rights obligations;
  • Meets prescribed conditions and complies with prescribed matters;
  • Meets the legal requirements;

 

 

 

Neighbourhood Plan Review

Strategic Environmentla Assessment (SEA) Screening

Broughton Astley Parish Council asked for a screening report to be undertaken in March 2025 to determine whether the Broughton Astley Neighbourhood Plan Review as provided by the Qualifying Body at March 2025 requires a Strategic Environmental Assessment (SEA) in accordance with the European Directive 2001/42/EC and associated Environmental Assessment of Plans and Programmes Regulations 2004.

The statutory consultees (Historic England, Natural England and the Environment Agency) were asked to comment on the Screening Report provided in April 2025. The Council provided its detemination in June 2025, which determined that the draft plan submitted in March 2025 did not require a full SEA

Regulation 14 Consultation

Broughton Astley Parish Council have announced that they are commencing the Regulation 14 consultation for the Broughton Astley Neighbourhood Plan Review.

The statutory Regulation 14 Consultation, will run for eight weeks from Friday 21 November 2025 to Friday 16 January 2026.

Approval of Neighbourhood Area

Broughton Astley Neighbourhood Area was approved by the Portfolio Holder on 29 October 2012.
