Noise and nuisance

Accumulations

Any accumulation or deposit which is prejudicial to health, or a nuisance can be dealt with as a statutory nuisance. The accumulation or deposit must have a direct physical effect on the use and enjoyment of a person’s property.  The mere presence of an accumulation, however unsightly, is not usually actionable under this area of law. Accumulations that have a frequent or constant foul smell or harbour vermin, however, can be investigated by us.

If any nuisance is caused by an accumulation or deposit on trade or industrial premises, we may not be able to take action if best practicable means have already been used to prevent, or reduce, the effects of any nuisance.
